Terms of Use

These terms form an agreement between you and Yumi Nexus for your use of Temi. They are written to set clear expectations while preserving any consumer rights that cannot lawfully be excluded.

1. Agreement

By downloading, accessing or using Temi: Rain or Shine (“Temi”), you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app.

2. Eligibility and your account

You must be at least 13 years old and legally able to enter this agreement. Temi uses the shared Yumi account portal at id.yumi.nexus. You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Contact us promptly if you believe your account has been compromised.

3. Licence to use the app

Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use Temi for your own lawful purposes on devices you own or control.

For copies obtained through Apple’s App Store, your app licence is also subject to Apple’s Standard Licensed Application End User License Agreement, unless Apple presents a valid separate licence. Apple is not responsible for providing Temi support; Yumi Nexus is responsible for the app and its services.

4. Your content and our limited permission

Your tasks, schedules, mood entries and other content remain yours. You give us only the permission reasonably necessary to host, process, back up and synchronise that content so we can operate Temi. You represent that you have the right to add the content and that it does not violate law or another person’s rights.

5. Features, reminders and location

Temi is a planning and reflection tool, not an emergency, medical or safety-critical service. Reminders depend on device settings, notification permissions, battery conditions and operating-system behaviour. You should not rely on Temi as the only way to remember something where delay or failure could cause harm.

If you use the place picker, location is used only as described in the Privacy Policy. A place attached to a schedule is informational and is not a navigation or emergency-location service.

6. Acceptable use

You must not misuse Temi or related services. This includes attempting to gain unauthorised access, disrupt the service, bypass security controls, scrape or automate the service in an abusive way, reverse-engineer protected service components except where law expressly permits it, or use Temi to violate law or another person’s rights.

7. Availability and changes

Temi is currently provided without charge. We may add, change or remove features, introduce optional paid features, or discontinue the service. Where a change materially affects existing users, we will aim to provide reasonable notice. The service may occasionally be unavailable for maintenance, security or circumstances outside our reasonable control.

8. Consumer rights

Nothing in these terms limits or excludes rights or remedies you have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other law that cannot lawfully be excluded. If Temi does not meet a non-excludable legal guarantee, the remedies available under that law continue to apply.

9. Disclaimers and limitation of liability

Except for rights that cannot be excluded, Temi is provided “as is” and “as available”. To the maximum extent permitted by law, Yumi Nexus is not liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, Temi. This section does not limit liability for fraud, wilful misconduct, or anything else that law does not allow us to limit.

10. Suspension and termination

You may stop using Temi and delete your account at any time through Settings → Account → Delete Account. We may suspend or terminate access where reasonably necessary to protect users or the service, comply with law, or address a material breach of these terms. Where appropriate, we will provide notice and an opportunity to resolve the issue.

11. Changes to these terms

We may update these terms as the product or legal requirements change. The current version and effective date will appear here. If a change is material, we will provide notice in the app or through another appropriate channel before it takes effect where reasonably practicable.

12. Governing law and contact

These terms are governed by the laws of New Zealand, without limiting any mandatory rights you may have under the law of your place of residence.
